ASSIVER (hereinafter “office”) takes your rights regarding data processing seriously. In this privacy statement we explain how we collect, process and use your personal data. It constitutes the firm's general policy regarding data processing in accordance with applicable legislation, including the General Data Protection Regulation (GDPR).

As an insurance broker, the office potentially fulfils a dual role in relation to data processing. In this respect, we are both the data controller and the data processor. We assume the role of data controller when we process data in our own name for our own account. In addition, we also fulfil the role of data processor on behalf of the companies. That means that we also collect and process personal data for insurance companies with whom we collaborate and from whom we present and offer products to you. In this notice, we only expand on how we process your data as a data controller.

WHEN DOES OUR OFFICE COLLECT AND PROCESS DATA?

The office collects and processes data about you when you contact us for the purpose of advice on insurance contracts, offering or proposing insurance contracts, carrying out preparatory work with a view to concluding insurance contracts and concluding insurance contracts themselves. You can also call on us or contact us for assistance with the management and implementation of the insurance contracts you have concluded. We will also (have to) process your data if you contact us in any other way. Finally, it is also possible that we obtain information about you from third parties and use this information to contact you to conclude an agreement through our mediation.


WHAT DATA DOES OUR OFFICE COLLECT AND PROCESS?

The office collects and processes data that you provide to us following contact with the office, such as your name, address, e-mail address and professional data, such as company name and VAT number. This also concerns all data necessary to allow us to assess your insurance needs. This includes data regarding your boat (in the context of boat insurance). Your data will only be processed in the context of the insurance for which you rely on us, unless you wish otherwise and indicate so.

FOR WHAT PURPOSES DOES OUR OFFICE COLLECT AND PROCESS DATA?

The purposes for which we process data are of various nature and are explained below.

For our customers, we process this data for customer management, in particular the acceptance, management and conclusion of insurance contracts and the promotion of other products and services of our office itself. These processing operations are mainly based on the contractual relationship with our customers, but also, as far as prospecting is concerned, on your explicit consent.

We process this data towards suppliers as part of our supplier management and on the basis of the contractual relationship that we have or are building with our suppliers.

As far as prospects are concerned, these are natural persons who are not (yet) our customers, we process the data for direct marketing purposes, on the basis of our legitimate interest in doing business. We ask prospects who are contacted by e-mail for their express permission to be able to contact them in the future. We request that prospects who are approached by letter tick an opt-out clause if they do not wish to be contacted by us any further.

We process the data for our employees for purposes such as personnel management and payroll administration.

With regard to our website, we tailor the content and ease of use as much as possible to you as its users. In addition, we process your data to comply with the obligations arising from providing a website and its content and to enable you to use the interactive applications and services on this website.


WHAT ARE THE BASIS FOR THE PROCESSING OF DATA BY OUR OFFICE?

In principle, we collect and process your data on the basis of the contractual relationship that we have with you as a result of your application or request in connection with an insurance need and the resulting agreement(s), as well as as a result of the request to assist you. are involved in the management and follow-up of the insurance contracts you have concluded.

Where the processing is not necessary for the performance of the contractual relationship, it is based on our legitimate interests as a company, in particular freedom of enterprise and information. We always ensure that there is a balance between our interests and yours, for example by granting you a right to object.

As far as health data or so-called sensitive data is concerned, we can only process your personal data with your explicit consent. You will be asked this when you become a customer with us. If this has not happened, we would like to ask you to inform us so that the necessary steps can be taken.


WILL THE DATA BE COMMUNICATED TO THIRD PARTIES?

Your data is mainly processed internally. This does not alter the fact that they must be communicated to the insurance companies with which we work.

We may rely on third parties for certain punctual services. In such cases, your data may be provided to these third parties, but only for the relevant service and always under the control of our office.

In certain cases there is a legal obligation to transfer certain data. This is especially the case when we are legally obliged to do so or when government authorities have the right to request data from us. In principle, your data will not be passed on to third countries or to international organizations.


YOUR RIGHTS

The regulations grant you various rights to ensure that you are adequately protected.

You can object at any time to the use of your data by our office for direct marketing purposes. If you do not wish to be kept informed of the offers from our office, you can report this via info@assiver.be or by checking a box in the information provided to you on specific occasions. You can always view the data that we process about you and, if necessary, have it corrected. In addition, you have the right to erasure of data, the right to restriction of processing, the right to portability, the right to object, the right not to be the subject of a decision based solely on automated processing, including profiling and the right to withdraw your consent. To this end, it is sufficient to request this via info@assiver.be or by post to ASSIVER, Kempenlaan 29, 2300 Turnhout, with proof of your identity. We ask this to prevent your data from being communicated to someone who is not entitled to it.

If you do not agree with the way we process your data, you can always file a complaint with the Data Protection Authority, Drukpersstraat 35, 1000 Brussels. You can also go there for all general questions regarding the processing and protection of personal data.
