Our approach

ASSIVER supports designers — individually or as part of a team — in managing their professional liability and arranging the appropriate insurance coverage.

We offer, among other things:

  • A review of the insurability of the contractual liability clauses imposed on you through agreements and specifications
  • A comparative market study tailored to your project and design team, providing a clear overview of the insurance options offered by all insurers active in this market
  • Our experience, enabling you to deal appropriately with any liability claims directed at you or your team

You can rely on our services for both traditional assignments and new forms of collaboration that are increasingly common in the construction sector, such as Build Team, Design & Build or DBFM projects.

We assist you in making arrangements with clients and contractors, with due regard for the independence of the design team, so that your professional liability insurer continues to provide coverage.

Because ASSIVER advises only architects and engineers, and not clients or contractors, we are able to guide you objectively.

We strongly prefer to advise you already during the contract negotiations. This allows you to gain a clear understanding of the liabilities the client wishes to assign to you and the extent to which these are insurable.

Coordinating the various insurance policies involved in a construction process also forms part of our services. While ASSIVER does not offer CAR, BA10, contractor’s liability or control insurance, we do know how these policies should be optimally aligned in the interest of the project.

Market study for a tailor-made insurance solution

When a design team is assembled for a specific assignment, a professional liability insurance policy that matches both the team and the project is required.

To this end, we map the team’s liabilities and draw up a “specification document” that we submit to all professional liability insurers. This clarifies which coverages and policy conditions must be offered to insure the design team correctly.

The outcome of our market study is presented in a comparative overview, giving you clear insight into the insurance options specific to your team and assignment.

A tailor-made solution, ensuring that the team’s professional liability is optimally insured.

Guidance throughout the entire policy term

ASSIVER does not let go after the policy is signed. We actively follow up in the event of:

  • Changes to payment terms
  • Suspension or delay of the works
  • Early termination of the assignment
  • Significant expansion or reduction of the project scope
  • Changes in the composition of the design team

During the design phase, the construction period and the ten-year liability period, you can rely on ASSIVER. We provide first-line advice on liability issues, whether preventive, to clarify your position, or necessary when action must be taken.

Support in the event of claims

We ask to be informed as soon as possible of any potential liability issue, so that our first-line advice can be as effective as possible.

Our advice can be preventive, for example when no claim has yet been made but you wish clarity on your position within the project due to certain circumstances.

In the event of an actual claim, ASSIVER acts as your trusted partner in dealings with the client, subcontractors, buyers, contractors, experts, lawyers and insurers. Thanks to our experience, built up over the past thirty years in handling construction-related claims, we can support you with expert knowledge.

Where your questions or needs require specialised advice, we put you in contact with the appropriate party: an expert, a lawyer, the insurer or another competent authority.

ASSIVER stands by your side in every claim, with the aim of providing certainty and peace of mind when your liability is at stake.
